Terms & Conditions
These terms govern all vehicle hire agreements between you (the Hirer) and JOLLY CAR RENTALS PTY LTD (ABN 98 670 960 040). By hiring a vehicle from us, you agree to the following terms.

1. Definitions
"Company," "we," "us," "our" refers to JOLLY CAR RENTALS PTY LTD (ABN 98 670 960 040), operating in the Goulburn Valley, Victoria, Australia.
"Hirer," "you," "your" refers to the individual named on the hire agreement who has been approved to hire a vehicle.
"Vehicle" refers to the motor vehicle described in the hire agreement, including all accessories, tools, and equipment.
"Hire Period" refers to the period from the date and time of vehicle collection to the date and time of vehicle return as agreed.
"Bond" refers to the refundable security deposit of A$500 paid at the commencement of the hire.
2. Eligibility Requirements
To hire a vehicle from Jolly Car Rentals, you must:
- Hold a current, full, and valid driver's licence (Australian or international with English translation). Learner permits and provisional licences are not accepted.
- Be at least 21 years of age.
- Provide valid photo identification (driver's licence or passport).
- Pay the A$500 refundable security bond prior to vehicle collection.
- Not be disqualified from driving or have your licence suspended or cancelled.
3. Security Bond
A refundable security bond of A$500 is required for all hires. This bond:
- Must be paid in full before the vehicle is released to you.
- Will be refunded in full within 7 business days of the vehicle being returned in the same condition as collected, less any deductions for damage, excess cleaning, fuel shortfall, traffic infringements, or toll charges incurred during the hire period.
- May be retained in part or in full if the vehicle is returned with damage, excessive wear, or in an unclean condition beyond normal use.
- Does not limit your liability — if the cost of damage or loss exceeds the bond amount, you remain liable for the balance.
4. Hire Rates & Payment
Hire rates are as quoted at the time of booking and are subject to change without notice for future bookings. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
Payment for the hire period is due in advance. For long-term hires (4+ weeks), payment may be made weekly in advance by arrangement with the Company.
Late return of the vehicle without prior arrangement will incur additional daily charges at the standard daily rate.
5. Insurance, Liability & Public Liability
Important: Please read this section carefully. It outlines your obligations and liabilities while in possession of a hired vehicle.
5.1 Comprehensive Vehicle Insurance. All vehicles are covered by comprehensive motor vehicle insurance maintained by the Company. This insurance covers damage to the hired vehicle and third-party property damage, subject to the terms, conditions, and exclusions of the insurance policy.
5.2 Excess / Liability Reduction. In the event of an accident, damage, or theft, the Hirer is liable for the first A$500 of any claim (the "excess"), regardless of fault. This amount may be deducted from the security bond. If the cost of damage exceeds the bond, the Hirer is liable for the difference up to the excess amount.
5.3 Public Liability. The Company maintains public liability insurance to cover claims arising from the use of our vehicles. However, this does not cover the Hirer's personal liability for:
- Injury to the Hirer or their passengers caused by the Hirer's negligence.
- Damage to the Hirer's personal property left in the vehicle.
- Any liability arising from the Hirer's breach of these terms and conditions.
5.4 Compulsory Third Party (CTP) Insurance. All vehicles are registered in Victoria and carry current CTP insurance (Transport Accident Commission — TAC) as required by the Transport Accident Act 1986 (Vic). TAC provides no-fault compensation for people injured in transport accidents in Victoria, regardless of who caused the accident.
5.5 When Insurance Does Not Apply. The insurance cover is void and the Hirer assumes full liability for all loss and damage if the vehicle is:
- Driven by a person not named on the hire agreement or who does not hold a valid full driver's licence.
- Used in breach of any road traffic law, including driving under the influence of alcohol or drugs.
- Used for any illegal purpose.
- Driven on unsealed roads, beaches, or off-road unless expressly authorised in writing.
- Used for racing, speed testing, or driver training.
- Driven outside the State of Victoria without prior written consent.
- Used to tow another vehicle or trailer.
- Operated in a negligent or reckless manner.
5.6 Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
6. Hirer's Obligations
During the hire period, you agree to:
- Drive the vehicle safely and in accordance with all applicable road rules and laws of the State of Victoria.
- Keep the vehicle locked and secure when unattended.
- Not smoke in the vehicle. A cleaning fee of A$250 applies for breach.
- Return the vehicle with the same fuel level as at collection, or pay a refuelling charge.
- Report any accident, damage, or mechanical issue to the Company immediately.
- Not sublet, assign, or transfer the vehicle or this agreement to any other person.
- Not modify, alter, or attach anything to the vehicle.
- Be responsible for all traffic infringements, tolls, and parking fines incurred during the hire period.
7. Accident & Damage Procedure
In the event of an accident, breakdown, or damage to the vehicle, you must:
- Ensure the safety of all persons involved.
- Call emergency services (000) if anyone is injured.
- Contact Victoria Police if required by law (e.g., injury, property damage over $1,000, or if the other party leaves the scene).
- Exchange details with all other parties involved (name, address, licence number, registration, insurer).
- Take photographs of all damage, the scene, and any other vehicles involved.

- Complete an accident report form provided by the Company within 24 hours.
- Do not admit fault or liability to any third party.
8. Vehicle Return
The vehicle must be returned on the agreed date and time, to the agreed location, in the same condition as collected (fair wear and tear excepted). The vehicle must be returned:
- Clean (interior and exterior) — a cleaning fee of up to A$150 may be deducted from the bond if the vehicle is returned in an excessively dirty condition.
- With the same fuel level as at collection.
- With all keys, accessories, and equipment provided.
Early return does not entitle the Hirer to a refund for unused days unless agreed in writing.
9. Termination
The Company reserves the right to terminate the hire agreement immediately and repossess the vehicle if:
- You breach any term of this agreement.
- The vehicle is used in a manner that may endanger persons or property.
- You fail to make a payment when due.
- You provided false or misleading information at the time of hire.
10. Privacy
We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. For full details, see our Privacy Policy.
11. Governing Law & Jurisdiction
This agreement is governed by the laws of the State of Victoria, Australia. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of Victoria.
